1. Agreement to Terms

Welcome to Smartermatch.ai (“Smartermatch”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your use of our website, services, and our browser extension (“Smartermatch IG Helper”), collectively the “Services”. By accessing or using the Services, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services.

3. Description of the Services

Smartermatch provides tools to help users organize and manage their Instagram follower network within a private dashboard. Certain features may include identity linking, synchronization utilities, and network visualization.

You agree that:

• You will use the Services in compliance with applicable laws and regulations.
• You are responsible for maintaining the confidentiality of your Smartermatch account credentials.
• You will only connect and sync data for accounts you are authorized to access.
• You are responsible for ensuring your use of the Services complies with any third-party platform rules that apply to you (including Instagram’s terms and policies).
• You will not use the Services or any synchronized data for automated spamming, harassment, or to bulk-sell, rent, or distribute contact information or follower lists.
• The synchronized follower data and any network insights provided in the dashboard are for your internal use within Smartermatch only. You may not export, republish, sell, rent, or redistribute it to build a competing directory or similar dataset.

6. Account Risk & Third-Party Platform Actions

The Services may interact with third-party platforms (e.g., Instagram) when you choose to use certain features. We implement safety measures intended to reduce excessive automated activity. However, we do not control third-party platforms, and they may take actions such as rate-limiting, restricting access, disabling accounts, or making changes to their systems or policies that affect functionality.

To the maximum extent permitted by law, Smartermatch is not liable for actions taken by third-party platforms.

7. Acceptable Use

You may not:

• Use the Services for unlawful purposes.
• Attempt to reverse engineer, bypass, or disable security features of the Services.
• Interfere with or disrupt the Services or servers/networks connected to the Services.
• Use the Services to access accounts or data you are not authorized to access.
• Use the Services to send spam, conduct harassment, or facilitate abusive behavior.
• Sell, rent, publish, or otherwise redistribute synchronized follower data outside of Smartermatch.

8. Intellectual Property

All content, trademarks, and materials on Smartermatch.ai (including software, text, graphics, and logos) are owned by Smartermatch or its licensors and are protected by applicable intellectual property laws.

9. Payments & Refunds

If you purchase paid Services, you agree to provide accurate billing information. Due to the nature of digital services, purchases are generally final once access has been granted. If you encounter issues, contact support@smartermatch.ai.

10. Termination

We may suspend or terminate your access to the Services if you breach these Terms or where we believe suspension/termination is necessary to protect the Services, other users, or comply with legal obligations.

11. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted, error-free, or fully secure operation of the Services.

12. Limitation of Liability

To the maximum extent permitted by law, Smartermatch and its affiliates, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.

14. Changes to Terms

We may modify these Terms from time to time. If changes are material, we will provide notice consistent with applicable law. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
